Royal Enfield Pre-Booking Terms & Conditions

Overview

These Terms & Conditions govern the use of the Royal Enfield pre-booking portal operated by IFAD Motors Limited. IFAD Motors Limited operates this site to allow its customers to pre-book its Royal Enfield Motor Bikes at their convenience. By visiting our Site, continuing to browse, or pre-booking any products through the Site, will be construed as your unequivocal and irrevocable acceptance and acknowledgement of the terms and conditions contained herein and binding policies hereof. By using the Site, you declare to have carefully read, understood, and agree to be bound by these Terms and Conditions. IFAD Motors Limited may, at its sole discretion, allow or disallow access to the Site and reserves the right to change any of the terms and conditions contained herein at any point in time. If you do not agree to all the Terms, then you may not access the Platform or use any of the services.

YOU/YOUR: You/Your shall mean a natural or legal person who is at least 18 years of age and could legally enter into a contract in Bangladesh and could use the services and products provided on the Site in accordance with the terms and conditions recorded hereinafter.

Continued Availability of This Site

IFAD Motors Limited shall endeavor to ensure that access to the Site is consistently available and is uninterrupted and error-free. However, due to the nature of the Internet and the nature of the Site, this cannot be guaranteed. Additionally, your access to this Site may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new facilities or services at any time without prior notice. IFAD Motors Limited will attempt to limit the frequency and duration of any such suspension or restriction.

Site Usage Eligibility

This Site is not available to persons under the age of 18, of unsound mind, or who are declared insolvent or to any Users suspended or removed from the system by IFAD Motors Limited for any reason. If you do not qualify, you may not use this Site.

Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the Platform or its contents:

• For any unlawful purpose;
• To solicit others to perform or participate in any unlawful acts;
• To violate any international, federal, provincial or national regulations, rules, laws, or local ordinances;
• To infringe upon or violate our intellectual property rights or the intellectual property rights of others;
• To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
• To submit false or misleading information;
• To upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services or of any related website, other websites, or the Internet;
• To collect or track the personal information of others;
• To spam, phish, pharm, pretext, spider crawl, or scrape;
• For any obscene or immoral purpose;
• To interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.

Section 1 - Product Information

• All products listed in the pre-booking portal shall be subject to availability. While we strive for accuracy, any changes will be communicated to customers through SMS/E-mail. IFAD Motors Limited reserves the right to update product offerings without prior notice.

Section 2 - Pricing, Payment & Availability

• Prices listed in the portal include applicable taxes unless specified otherwise.
• Payment can be made through online gateways or at the showroom. You agree, understand, and confirm that the details of payment methods provided by you for making payment through online gateways while pre-booking products on this Site are correct and accurate, and you shall not use any payment instrument which is unlawfully owned by you. Thus, you must not pay or attempt to pay for services using fraudulent information.
• Your personal data including, without limitation, details relating to debit card/credit card/net banking/digital account/bkash account/ipay account, etc., transmitted over the internet may be susceptible to misuse, hacking, theft, and/or fraud, and IFAD Motors Limited has no control over such matters and assumes no responsibility for the same.
• Pricing is subject to change, and customers will be informed of any adjustments before finalizing payment.
• Availability of the selected product is subject to stock.
• Only one motorcycle can be pre-booked per registered mobile number.

Section 3 - Pre-Booking Conditions

• All pre-bookings must be made through the Royal Enfield online pre-booking portal only (https://prebook.ifadmotors.com/).
• In case any customer wants to pre-book from the showroom, they can check and choose the models and colors in person, but they must pre-book using the online portal only.
• Customers must register/enter the portal using their mobile number and can enter the portal by receiving an OTP.
• Payments will be confirmed once the amount is received in the company's account:
  • Online Payments & Card/Cash at Showroom: Confirmation within 2/3 working days.
• Customers can check their payment status by logging into their pre-booking account using their registered number.
• Pre-booking is completed only when the payment is confirmed.
• The pre-booking session will be canceled if payment is not completed.
• Customers must restart the pre-booking process if logged out before completing payment.
• Order confirmation will be sent via email & text SMS.
• Customers will receive the invoice via email after successful payment.

Section 4 - Payment at Showroom

• Cash payments must be made to the showroom cashier, and the receipt must be uploaded to the pre-booking portal.
• After payment, the booking status will remain PENDING until confirmed by the company's accounts department.
• Failure to upload the receipt will result in an incomplete booking.

Section 5 - Changes & Adjustments

• Changes to model, color, or specifications can only be made after payment confirmation and must be done at the showroom within 15 days of confirmation.
• Changes can be provided as per the availability of the model.
• Changes to the model or color may shift the tentative delivery date.
• Model or color changes can only be made once.

Section 6 - Booking Cancellation

• If any customer wants to cancel the order, they can come to the showroom or can contact our helpline: 16598 or email us at [email protected].
• A Cancellation charge will be deducted in accordance with company policy.
• Cancellation status will be informed via email & text SMS.
• Any customer must generate the cancel request within 30 days.

Section 7 - Delivery Terms

• A tentative delivery date will be provided in the pre-booking portal after payment confirmation.
• Delivery dates may change based on production schedules and stock availability.
• Customers must collect their motorcycle from the showroom specified during pre-booking with the booking invoice/money receipt.
• Any changes in the delivery dates or stock shortage will be informed via email & SMS.

Section 8 - Refund Policy

• Refund requests can be made at the showroom/dealer or by emailing us at [email protected] along with the invoice/money receipt and bank account details.
• Refunds will be processed within 30 working days from receipt of the refund request.
• Refund amount (via cheque) must be collected from the head office.
• Refund status will be informed via email & text SMS.
• All requests for refund(s) shall be on a case-by-case basis. IFAD reserves the right to refuse the refund facility to any User at its own discretion.

Section 9 - Communication & Support

• Customers will receive updates on booking status, payment, and delivery via SMS or email. Customers must provide a valid email address and contact telephone and/or mobile number to IFAD Motors Limited for this purpose.
• Any delays or changes in delivery will be communicated accordingly.
• Customer support is available via phone, chat, or email for inquiries regarding pre-booking or delivery.

Section 10 - Accuracy of Billing Information

• Customers are responsible for providing accurate personal and billing information during the pre-booking process. IFAD Motors Limited is not liable for delays or issues caused by inaccurate information.

Section 11 - Personal Information & Privacy

• Customer personal data is collected solely for processing pre-bookings and facilitating communication regarding orders when a customer fills up the contact details (not any financial details).
• This data will be securely stored and not shared with third parties except as necessary for order processing and delivery unless such a disclosure is authorized or required by law, or you have expressly consented to such a disclosure. Please refer to our privacy policy for details.

Section 12 - Governing Law

• These Terms & Conditions are governed by the laws of Bangladesh. Any disputes arising from the pre-booking process will be resolved in accordance with the jurisdiction of the courts in Dhaka.

Indemnification

• Users agree to indemnify IFAD Motors Limited as well as its officers, directors, employees, agents from and against all losses, expenses, damages, and costs, including legal fees, resulting from any violation of these Terms and Conditions (including negligent or wrongful conduct).

Force Majeure

• Neither Party shall be in default of its delay in performance or failure to perform any of its obligations hereunder when and if the delay or failure arises from a cause which is beyond the control of the party failing to perform. Such force majeure (which includes, inter alia, strikes, acts of God, acts of war, laws and regulations) would suspend the fulfillment of the obligations under this Agreement until it is over.

Section 13 - Changes to Terms & Conditions

• IFAD Motors Limited reserves the right, at its sole discretion, to update, change, or replace any part of these Terms & Conditions by posting updates and changes to this Site. Such modifications shall be effective immediately upon posting on the Platform. It is your responsibility to check the Site periodically for any updates and changes. You can review the most current version of the Terms & Conditions at any time on this Site. Your continued use of or access to our Site following the posting of any changes to these Terms & Conditions constitutes acceptance of those revised changes.
